Ms. Anne Norri~ <br />Page <br />January 9, 1986 <br /> <br />use within the GFP, but any filling, etc. requires a <br />conditional use permit. The conditional use permit <br />procedure stated in Section 170.069.11 requires a detailed <br />hydrologic/hydraulic analysis of the flood elevations for <br />the area. The DNR is required to be involved in this <br />conditional use permit review process. The EAW for the <br />project references e flood fringe area, indicating to me <br />that either a detailed study has already been done or <br />terminology has been confused. It appears that the flood <br />elevations for Trott Brook have been used for determining <br />boundaries around Lake Itasca. This is an incorrect <br />assumption since the flood plain areas are separated. At <br />any rate, the detailed study of the flood elevations and <br />associated impacts due to the project must be completed <br />and/or reviewed to determine the accurate flood plain <br />boundaries prior to considering a conditional use permit. <br />The only reason that a conditional use permit would not be <br />required is if absolutely no alteration of the flood plain <br />will occur. <br /> <br />e <br /> <br />Shoreland - The City's Environmental Protection Ordinance <br />Number 85-2 contains ahoreland management standards and <br />requirements which were fully addressed in the EAW. The <br />project is a PUD; however, since the proposed lot size <br />exceeds the 80,000 square foot standard of Section <br />l?0.0112D.e.l., the project does not require D~R approval as <br />stated iu Section I?0.0112D.J.2 - (there are not "altered <br />zoning standards" as stated in this section). <br /> <br />The EAW failed to mention some of these required reviews and permits, <br />so I wanted to be sure they were made known early on alerting the <br />developer and the City of the required processes.
