RESTATED DECLARATION OF COVENANTS, CONDITIONS <br /> AND RESTRICTIONS FOR NORTHFORK <br /> <br /> THIS RESTATED DECLARATION (hereinafter referred to as the <br /> <br />"Declaration"), is made this day of January, 1986 by North <br /> <br />Fork, Inc., a Minnesota corporation (hereinafter referred to as <br />"Declarant"), Sherburne Homes, Inc., a Minnesota corporation, <br />Delserve, Inc., a Minnesota corporation, Gramstad Homes, Inc., a <br />Minnesota corporation and Northfork Homeowners Association, Inc., <br />a Minnesota nonprofit corporation. All of said persons are here- <br /> <br />after referred to as the "Parties". <br /> W I T N E S S E T H: <br /> <br /> WHEREAS, the Parties are the owners of that certain real <br />property located in Anoka County, Minnesota, legally described in <br />Section 1.1, Paragraph 1, hereof (hereinafter called the <br />"Property"), as follows: <br /> <br /> Sherburne Homes, Inc. -- Lots 11 and 15, Block 1 <br /> Delserve, Inc. -- Lot 14, Block 1 <br /> Gramstad Homes, Inc. -- Lot 13, Block 1 <br /> Northfork Homeowners Association, Inc. -- Outlots A <br /> and B <br /> Northfork, Inc. -- all other lots <br /> <br />and desire to create thereon a residential community with open <br />spaces and common area facilities for the health, safety, recrea- <br />tion and general benefit of said community; and <br /> <br /> WHEREAS, the Parties desire to provide for the preservation <br />of the values, aesthetic character and amenities in said commun- <br />ity and for the maintenance of open spaces and other common <br />facilities and to this end desires to subject the Property, <br />together with such additions as may thereafter be made hereto, to <br /> <br />the covenants, restrictions, easements, charges and liens (here- <br /> ,/I./'G <br /> <br /> " <br /> <br /> <br />
