Page <br /> <br />--Exempts municipalities from liability for claims of a <br /> user of municipal recreation facilities, except for <br /> conduct that would entitle a trespascer %o damages <br /> against a private person. <br /> <br />--Exempts municipalities from liability for claims of a <br /> loss of public welfare benefits or compensation except <br /> when required by federal law. <br /> <br />--Exempts municipalities from liability for claims of <br /> loss due to failure of a person to meet standards <br /> required for a municipal license, permit, or other <br /> authorization. <br /> <br />--Exempts municipalities from liability for claims based <br /> on care or treatment, or lack thereof, of a person at <br /> a municipal or corrections facility. <br /> <br />--Exempts municipalities from property claims of municipal <br /> institution patients or inmates. <br /> <br />--Exempts municipalities from claims due to conditions of <br /> unimproved real property owned by a municipality. <br /> <br />--Exempts municipalities from liability for claims for the <br /> care or custody of a motor vehicle driven by a person <br /> arrested for driving under the influence of alcohol when <br /> the arresting officer acts in good faith and exercises <br /> due care. <br /> <br />--Specifies which persons must give a municipality notice <br /> when claiming tort liability damages against a munici- <br /> pality or municipal employees. Requires the names of <br /> the municipal employees known to be involved be included <br /> in the notice. Deletes provision requiring that notice <br /> must be given and that the action must be commenced <br /> within one year after notice is given, if action is to <br /> be maintained. Deletes exceptions to the notice <br /> requirement. <br /> <br />--Prohibits a municipality from indemnifying (protecting <br /> or holding harmless) an officer or employee for punitive <br /> damages. Does allow the municipality to provide a <br /> defense against such a claim if the defense is necessary <br /> to other elements of a defense. <br /> <br />--Requires the state to indemnify (protect or hold <br /> harmless) a municipality for tort liability when the <br /> municipality acts as an agent of the state. <br /> <br /> <br />
