ADDITIONAL 1TEMS FOR REVIEW

In reviewing the present Ramsey Liquor Ordinances, the Co~mission
would like to bring the following areas to the attention of the
Council.

We reco~rm~end that the City charge $200.00, which is allowable
according to State law.

The City presently charges $150.00 for an Off-Sale license.

2. Our ordinance presently requires liability insurance of
$100,000 per person and $300,000 aggregate. This ~nount of
insurance is outdated for this type of business. We feel that
the coverage should be $300,000 per person and $1,000,000
aggregate. This recommendation should be discussed with the
City's attorney.

3. We see a problem that may arise in the future because of~
one of our present On-Sale establishments not adhereing to th~
present ordinance as it is written. Section 130.051 No. 3 ~
states the followingz The term "restaurant" means any establish-~
ment, under the control of a single proprietor or manager, ~
having appropriate facilities to serve meals, for seating ~
not less than one hundred twenty (120) guests at one time in
one (1) or more dining rooms having a total dining area of at
least two thousand five hundred (2,500) square feet, and where
in consideration of payment therefor, meals are regularly
served at tables to the general public, and which employs an
adequate staff for the usual and suitable service to its guests
and the principal part of the business of which is the serving
of foods] (The term "principal p~rt of the business" means ~
more than 40% of gross sales.) / ~/

We think we realize why the Council does not enforce this
section of the ordinance in this situation, but we feel that
it may leave the City in a precarious situation in the future
as far as

a. Future On-Sale applicants may want the same privilege

b. Liability to the City for not enforcing the ordinance
as wTitten.

Respectfully submitted,

Gary Gorham - Chairman
Roy Schumway - Secretary
Astrid Guy
A1 Kempf
Bill Pittman
Bob Kuhn - Ex Officio Member
