JOINT POWERS AGREEMENT <br /> <br /> THIS AGREEMENT made and entered into between the CO:JNTY OF' ANOHA, State <br />of Minnesota, by and through the Anoka County r~oard of Commissioners, hereinafter <br />referred to as the "COUNTY", and the CITY of FRAMSEY, herelqafter referred to os the <br />"MUNICIPALITY". <br /> <br />WITI~SSETH: <br /> <br /> WHEREAS, Minn. Stat. Section t 15A.919 ~'1985), (hereinafter Surcharge Statute) <br />provides that: <br /> <br />A county may irnpose a fee~ by cubic yard of waste or its equivalent, on <br />operators of facilities for the disposal of mixed municipal solid waste located <br />within the county. The fee in the metropolitan area may not exceed 25 cents <br />per cubic yard, or its equlvalent. The revenue from the fees shall be credited <br />to the county general fund and shall be used only for landfill abatement <br />purposes, or costs of closure, postclosure care, and response actions or for <br />purposes of mitigating and compensating for the local risks~ costs, and other <br />adverse effects of facilities. <br /> <br /> WHEREAS, the County imposed a 25 cent per cubic yard fee effective January <br />1985, at all mixed municipal waste landfills located within its borders; and <br /> <br /> WHEREAS, on April 16, 1985, the Anoka County Board of Commissioners adopted a <br />policy whereby a certain portion of the fees collected under the Surcharge Statute are <br />available for distribution to municipalities within Anoka County to reimburse eligible <br />expenses for local landfill abatement activities; and <br /> <br /> WHEREAS, Ano~<o County has allocated up to ~1.25 per household from t985 <br />surcharge collections for landfill abatement activities in the Municipality in accordance <br />with Metropolitan Council and Legislative direction to have recycling and composting <br />activities expanded at the local level; and <br /> <br /> WHEREAS, the parties are authorized and empowered to enter into this Agreement <br />pursuant to Minn. Stat. Sections ~,71.59 and t~73.81 I, Subd. 7. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants and promises <br />contained in this Agreement, the parties mutually agree to the following terms and <br />conditions: <br /> <br />I. PURPOSE <br /> <br /> The purpose of this Agreement is to provide for cooperation between the County and <br />the Municipality to implement landfill abatement programs in the Municipality. <br /> <br />2. TERM <br /> <br /> The term of this Agreement is from April 16, 1985 to December 31, 1987, the date <br />of the signatures of the parties notwithstanding, unless earlier terminated as provided <br />herein. <br /> <br /> <br />
