3. PROGRAM The Municipality shall perform landfill abatement activities substantially as set forth in the landfill abatement work plan attached as Exhibit A, which is made a part of this Agreement. REPORTING The Municipality shall, on a semi-annual basis, submit to the County an accounting of the amount of waste which has been diverted from landfills. F-or composting programs, an estimate shall be provided of the number of cubic yards or tons of yard waste brought to a composting site(s1 together with a description of the methodology used for calculations. F'or source separation recycling programs, documentation shall be provided showing the number of tons of each recyclable material which has been collected and the number of tons of each recycloble material which has been marketed. The Municipality agrees to furnish the County, on o semi-annual basis, information regarding any revenue received from sources other than the County for landfill abatement activities set forth in Exhibit A. The Municipality agrees to furnish the County with additional reports in form and at frequencies requested by the County for financial evaluation and program management purposes. S. BILLING Al,ID PAYMENT PROCEDURE The Municipality shall, on a semi-annual basis, submit itemized invoices to the County for eligible abatement activities, in a form acceptable to the County. The invoices shall be paid in accordance with standard County procedures, subject to the approval of the Anoko County Board of Commissioners. Only those activities which ore identified in Exhibit A shall be eligible for funding under this Agreement. Landfill abatement costs incurred by the Municipality which ore reimbursed by o source other than as provided for in this Agreement are not eligible for further reimbursement under this Agreement. Any revenues received from landfill abatement activities identified in Exhibit A shall be used only for landfill abatement activities. 6. AVAILABILITY OF FUNDS Notwithstanding any provision of this Agreement to the contrary, the maximum amount that the County will reimburse to the Municipality under this Agreement shall be $3,602.00. If landfill surcharge monies collected by the County and allocated to cities and townships for local landfill abatement activities are inadequate to meet the County's allocation to the Municipality under this Agreement, the County may reduce the maximum amount reimbursable under this Agreement after giving written notice to the Municipality. The County makes no commitment to fund future landfill abatement programs and assumes no liability for payment of any money from the County's general fund except for reimbursement of abatement activities by the Municipality os provided herein. -2-
