GERAI~ lOOT 1, That on December 17, 1985, the Ransey City Council approved a request by Nr, Gerald Root, 16208 Coquina Street N,W,, for a conditional use permit to operate an auto, s·bile sales and repair business in the UHB District at l&700 Nowtheu Boulevard. 2. That the Council's approval of the per, it included certain conditions contained in the conditional use per,nit agreement relating to the operation of Hr. Root's business. These conditions include: a. ~o salvage or junk yard activities conducted from the premises; b. Adequate on-site parking to be provided; c. No outside storage of materials other than automobiles for sale; and d. Hours of operation shall be 8:00 a.m. to 8:00 p.m. Honday through Friday and 8:00 a.m. to 5:00 p.m. on Saturdays. 3. That Section 170.015I(6)VLII(C) of the City Code requires that off- street parking areas {including open sales lots for cars, trucks and other equipment) shall be paved with a durable and dust free surface in accordance with City standards. &. That on June 3, 1986, City staff notified Hr. Root by letter of apparent violations of conditions of the conditional use permit agreement regarding outdoor storage, salvnge operations, hours of operation and condition of parking area. 5. That on July 17~ 1986, City staff notified Hr. Root by letter of continued violations of the conditional use per·it agreement and that failure to resolve these violations would initiate proceedings for the revocation of Hr. Root's conditional use permit. 6. That on July 17, 1986, City staff also notified Hr. Root that it appeared that he vas storing construction vehicles and equipment on the pre~ises, which is not a permitted use in the ~ District. 7. That on July 23, 1986, Mr. Root telephoned City staff and stated that he would comply with all the conditions of the City Code and conditional use permit a&reement within one month. 8. That on August 6, 1986, City staff notified Hr. Root by letter that the City Council would consider revocation of the conditional use permit in accordance with the City Code based on apparent violations regarding outdoor storage of materials, hours of operation, and parking area. 9. That Section 170.016C of the City Code states that the term of · conditional use permit shall be indefinite and may be revoked only upon an affirmative shoving that the site is not being used for the use originally authorized in the conditional use permit issued and in accord with the conditions attached by the City Council. 10. 11.
