FROPOSED FI~DII~C$ OF YACT ~01., <br /> CEaALD ROOT <br /> <br /> 1. That on December 17, 1985, the Ramsey City Council approved a request <br />by Mr. Gerald Root, 16208 Coquina Street N.W., for s conditional use permit to <br />operate an automobile sales and repair business iR the UMB District at 11700 <br />Rowthen Boulevard. <br /> <br /> 2. That the Council's approval of the permit included certain conditions <br />contained in the conditional use permit agreement relating to the operation of <br />Mr. Root's business. These conditions include: <br /> <br />a. 1% salvage or junk yard activities conducted from the premises; <br />b. Adequate on-site parking to be provided; <br />c. No outside storage of materials other than automobiles for sale; <br /> and <br />d. ]iours of operation shall be 8:00 a.m. to 8:00 p.m. Nonday through <br /> Friday and 8:00 a.m. to 5:00 p.m. on Saturdays. <br /> <br /> 3. That Section 170.015I(6)¥III(C) of the City Code requires that off- <br />street parking areas (including open sales lots for cars, trucks and other <br />equipment) shall be paved with a durable and dust free surface in accordance <br />with City standards. <br /> <br /> 4. That on June 3, 1986, City staff notified ~r. Root by letter of <br />apparent violations of conditions of the conditional use permit agreement <br />regarding outdoor storage, salvage operations, hours of operation and condition <br />of parking area. <br /> <br /> 5. That on July 17, 1986, City staff notified )ir. Root by letter of <br />continued violations of the conditional use permit agreement and that failure <br />to resolve these violations would initiate proceedings for the revocation of <br />)ir. Root's conditional use permit. <br /> <br /> 6. That on July 17, 1986, City staff also notified )ir. Root that it <br />appeared that he was storing construction vehicles and equipment on the <br />premises, which is not a permitted use in the UMB District. <br /> <br /> 7. That on July 23, 1986, Mr. Root telephoned City staff and stated that <br />he would comply with all the conditions of the City Code and conditional use <br />permit agreement within one month. <br /> <br /> 8. That on August 6, 1986, City staff notified )ir. Root by letter that <br />the City Council would consider revocation of the conditional use permit in <br />accordance with the City Code based on apparent violations regarding outdoor <br />storage of materials, hours of operation, and parking area. <br /> <br /> 9. That Section 170.016C of the City Code states that the term of a <br />conditional use permit shall be indefinite and may be revoked only upon an <br />affirmative showing that the site is not being used for the use originally <br />authorized in the conditional use permit issued and in accord with the <br />conditions attached by the City Council. <br /> <br />10. <br /> <br />11. <br /> <br /> <br />
