WHEREAS, that on September 17, 2003 the CITY entered into a Master Development <br />Agreement with Ramsey Town Center LLC regarding the development of a project known as <br />Ramsey Town Center Addition; and <br /> <br /> WHEREAS, the Subject Property is located within the plat of Ramsey Town Center <br />Addition, Anoka County, Minnesota and thus subject to the terms and conditions of the Master <br />Development Agreement. <br /> <br /> Ramsey Town Center Development Agreement. By execution of this Agreement, <br />DEVELOPER acknowledges the Subject Property and its development contemplated by the <br />Preliminary Plat is subject to the terms and conditions of that certain document entitled: <br /> <br />"ciTY oF ~¢~4MSEY <br /> <br />MASTER DEVELOPMENT AGREEMENT <br />FOR RAMSEY TOWN CENTER <br /> By and Between <br /> CITY OF RAMSEY <br /> And <br /> RAMSEY TOWN CENTER LLC <br /> <br />Dated September ] 7, 2003" <br /> <br />(the "Master Development Agreement") <br /> <br />The terms and conditions of the Master Development Agreement are incorporated herein by <br />reference as if fully set forth at this point. DEVELOPER further acknowledges, by <br />execution of this Agreement, receipt of a copy of the Master Development Agreement. <br /> <br />In the event of a conflict between the terms of this Agreement and the terms of the Master <br />Development Agreement, the Master Development Agreement shall control. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br /> SECTION I <br />REQUIRED IMPROVEMENTS AND FINANCIAL RESPONSIBILITIES <br /> <br />City Code Compliance. The CITY approves the Plat conditioned on the DEVELOPER <br />developing the Plat in accordance with the applicable provisions of City Code. <br /> <br />Conformance with Plan. The Plat shall be developed pursuant to the plans consisting of <br />Final Site Plan, Final Landscape Plan prepared by RJT Architects, Inc. dated June 16, 2004, <br /> <br />Ramsey Town Center 4th Addition <br />NAU/Sharp and Associates <br />Development Permit <br /> Page 2 of 10 <br /> <br /> <br />
