IO~fhloon Ron',r)ft <br /> <br />Mr. Kempf was present representing his wife. <br /> <br />Motion by Councilmember Schlueter and seoonded by Councilmember Sorteberg to <br />adopt Findings of Fact relating to Ms. Kathleen K~pf's request for a <br />oonditional use permit to operate a folk art instruction business from her <br />home. (Please refer to findings of fact file for Findings of Fact). <br /> <br />Motion carried. Voting Yes: Mayor Beitman, Councilmembers Sorteberg, Beimann <br />and Schlueter. Voting No: Oouncilmemker Cox. <br /> <br />Motion by Councilmeuber Schlueter and seconded by Councilme~ber Reimann, for <br />discussion, to approve Ms. Kathleen Kempf's request for a oonditional use <br />permit to operate a folk art instruction business from her h(~e oontingent upon <br />Ms. KemlX entering into a ~onditional use permit agreement with the City. <br /> <br />Further Discussion: Councilm~d~r Reimann stated that home occupation permit <br />agreements should require a bond or letter of credit being lxovided. <br />Councilmember Reimann inquired as to the perking facilities. Mr. Kem~f stated <br />that the maximu~ n~tnber of students that would be present at any given time is <br />6 and with respect to perking, he has a 180' double wide driveway. <br />Councilmember Cox inquired if there is adequate water supply and sewer <br />facilities at the site. Mr. Kem~f replied that he has 600 square feet of <br />drainfield. Councilmember Cox inquired if Mr. Kempf would be willing to waive <br />his homestead tax credit rights because of the business. Mr. Kemp replied that <br />in this case, the only part of the home that can be oonsidered tax deductible <br />is less than 1%; the profit from this business is projected to be $5,000/year <br />and therefore cannot afford to rent cxxmmercial property. Mr. Kem~f also noted <br />that this is a low traffic flow business. Councilmember Gox stated that the <br />$5,000 profit is taken away from a business owner paying to be in a commercial <br />zone. Councilmember Gox noted that in the p~st Mr. gempf was adimant about not <br />having cx~mercial developed adjaoent to his home and now he wants o0mmercial in <br />his home to avoid paying the freight in a ~ercial area and taking business <br />away from the ocm~ercial area. <br /> <br />Motion failed. Voting Yes: Gounci~rs Sorteberg and Schlueter.
