(Duncilm~rber Schlueter also noted that
Oouncil unanimously denied Mr. Ness; pres~re that this motion does not include
reversing the action in Mr. Ness' case. Mayor Hei~an stated that his ultimate goal
to get out of the process of p~h~_ic hearings on rsguests for variances to
structure size; the ordinance states the size limits, City Staff can enforoe
that ordinance at the City }~%11 ~ounter and citizens can save thyselves $90.
Go~cilm~ber Schlueter stated that ~he will not give a blanket ap[x(wal to the
board of adjustment varianoes that were tabled. (D~cilme~ber (Dx stated that
he disagrees with the Attorney's opinion; the ordinance was adopted with the
intent that people have the right to go beyond the City Staff level and
before the elected officials with their request; it appears that we are trying
to take that right away. (Duncil~ber Sorteberg suggested an adjustment to
the square footage all~ed could alleviate the ~d for board of adjustment
public hearings and meetings. (buncilm~ber Sorteberg stated that (Duncil
should meet with Planning and Zoning on October 1 and resolve the ordinance and
tabled r~guests for variance issues at the October 8 (buncil ~eeting; also not
in favor of a blanket decision. O~uncil~ber Reimann stated that he is not in
favor of a blanket decision. O)uncilm~ber (Dx stated that another concern is
that people understand that the $90 board of adjustment fee does not guarantee
an approval to the request.

Motion failed.
