Comcil noted letter dated September 23, 1985 to Paul Ruud, Anoka <br />Oomty Engineer, fr(~ the City Engineer reegarding the flooding proble~ on <br />Gouty Road ~116. <br /> <br />2. Oo~cil noted letter dated September 23, 1985 fr~ City Engineer <br />regarding the flooding of 149th Avenue N.W. in Pineview Estates. <br /> <br />3. Gouncil noted list of high water or flooding problems Ixepared by the <br />City Engineer. <br /> <br />Mrs. Peterson of 7351 151st Avenue, Mrs. Bancroft of 7431 151st Avenue and <br />Jiw Battenberg 7471 150th Lane were present. <br /> <br />Mrs. Peterson stated that the mR controlled ponding area is flooding her <br />home and inquired as to what gives ~ the right to do this to her <br />property. <br /> <br />Mr. Battenberg stated that there will be a major flooding proble~ in the <br />Spring of 1986. Mr. Batenberg stated that he doesn't want to see the pond <br />disappear but [~R should put in a gate and pu~p the excess water to the <br />river; a solution is expensive and will not [my to solve the proble~ in <br />view of the fact that ~ claims jurisdiction to half of his Property by <br />encroaching wetlands and he must pay the property ta~es. Mr. Battenberg <br />noted that there are 4 lots on 149th that are in the mR wetlands that are <br />considered buildahle lots by the City of ~m~sey. <br /> <br />Gouncil~ber (bx stated that installing storm sewer requires that all <br />benefitted property ~ers be assessed; this assessment could bankrupt <br />certain Properties between this problem area and the river; this could <br />result in a failed petition which the Charter says prohibits the project. <br /> <br />Mr. Goodrich stated that the project would be prohibited unless there is a <br />successful petition by 50% of the registered voters to lmy for the project <br />out of the City's 9eneral ta~es. <br /> <br />Mayor Heitman stated that a storm sewer Project could be ps/d for by <br />bonding and this is subject to a referendu~ vote. <br /> <br />Mr. Battenberg stated that this area is Class II wetl~]s which m <br />it is supposed to dry up and it's not; he has been dealing with IINR for <br />more than two years and by the time the probl~ is solved, the h(~es will <br />be worthless. <br /> <br />Mayor Hei~an stated that at this point it see~s that all the City can do <br />is be an advocate on behalf of the affected citizens; there isn't anything <br />else the City can do other than to put in a storm sewer project that the <br />City cannot afford. <br /> <br />September 24, 1985 <br /> <br />Page 16 of 21 <br /> <br /> <br />
