I
I
I
I
I
I
I
I
I
:1
'1
'1
I
I
I
I
I
I

Mr. Fountain inquired that if the landfill were to close i~ediately, would
Waste Management need all that soil for closure/post closure.

Mr. Otter replied that they probably would rK)t. ]~e stated that there are
daily cover activities going on that cons~e soil and Waste Management would
like to leave that property in a useable form without creating too deep of an
excavation on the existing 160 acres. Waste Management is requesting a minin9
permit in order to leave the property in decent condition.

Mr. Goodrich inquired if the Tri-CO property will be acceptable for
development when the mining process is over with.

Mr. Otter replied that it will be.

Mr. Hermanson - When soil is mined, will it be in contour with the rest of the
land.

Mr. Otter replied that the mean across the property would be 9.1'.

Mr. Studer stated that fill on the property could be considered a resource and
maybe should be left alone for a greater future need.

Commissioner Deemer stated that there is a moratorium on the property because
it is included in the County's Landfill Inventory List; Metro Council is not
going to let someone else come in and mine the fill and haul it away but it
could be to Metro Council's benefit to let Waste Management mine the fill in
order to maintain an ecological situation on the current landfill.

Oommissioner Zin~nerman inquired as to what assurance the City has that the
fill will be used as oover only.

Mr. Goodrich replied that the use of the fill is not what the Commission is
supposed to be reviewing; Co~nission should be considering the conditions of
the mining permit. Commissioner Zin~,erman's question might better be answered
by Metro Council; if the Metro Council is serious about Site P they may want
to keep that fill right here in Ramsey.

Ore, missioner Hendriksen stated that the proposed time frame seems quite
lengthy to be considered a temporary conditional use permit.

Mr. Goodrich replied that regular conditional use permits are perpetual;
temporary conditional use permits are for uses that have a beginning and an
end. ~he only guideline you have is that there is an end to the mining
process in sight. Mr. 6bodrich stated that he has also discussed this issue
with Mr. LeFevere and based on his experience, he recommended going with a
temporary conditional use permit. ~he only difference beb~een a temporary and
regular oonditional permit is that a public hearing is not required for a
temporary permit; a mining request is unusual but not sufficient reason to put
the applicant through the extra hurdle of a public hearing.

Commissioner Zi~merman stated that he does not feel the time frame proposed
should be considered temporary.

Mr. Goodrich stated that Council did not know the mining would be a 15 year
