It is difficult to <br />estimate a closing date because it depends on the daily volume taken in at the <br />site; there may even be a reduction in the daily volt, ne now that d~nping costs <br />will rise due to local, County and State surcharges. <br /> <br />Mr. Goodrich stated that he will also reoommend to Council, if the mining <br />permit is approved, that the final resolution include that even though the <br />amount of mining or fill the City permits Waste Management exceeds what would <br />be needed on the existing site, in no way does this permit grant Waste <br />Management thereby an expansion of this site. <br /> <br />Discussion ensued regarding granting the mining permit for a limited amount of <br />time, 5 years for instance, and a review and reapplication of the case at that <br />time. <br /> <br />Commissioner }3endriksen reiterated that 15 years is a long period of time for <br />a temporary use and the criteria for same states that the activity cease <br />before there is an adverse affect on the property. <br /> <br />Mr. Otter noted that just with the County ordinance on closure/post closure he <br />is tied to a minimum of 10 years which extends way beyond the 5 years the <br />Commission is discussing. <br /> <br />Commissioner Deemer stated that the Commission is discussing a mining permit <br />for a reasonable amount of time for every day operation of the landfill until <br />it's volL~ne capacity; at that time a temporary mining permit could be issued <br />for shorter periods of time, say 3 weeks a year, for closure/post closure <br />requirements. <br /> <br />Con~nission consensus is to recommend that Council, if they approve the mining <br />permit request, set up the mining permit for a 5 year time frame; that while <br />the Commission understands that Waste Management is tied to a need for fill <br />for a minimum of 10 years, 15 years seems to be more than temporary. <br /> <br />Mr. Goodrich pointed out that the Conmtission is not relating the request to <br />mine with the landfill; it is legitimate that the Commission feels the City <br />should be able to review what is happening on the Tri-Co property 5 years from <br />now. <br /> <br />(k~mission consensus is that Council also accept all recommendations made by <br />the City Engineer in his letter dated Nove{nber 30, 1984 regardin9 Waste <br />Management request for a mining permit; that Waste Management oomply with <br /><~apter 70 of the Uniform Building Oode; and that fill should not be <br />transported over public thoroughfares; that hours of mining activity shall be <br />from 7:00 a.m.-5:00 p.m. on weekdays, 8:30 a.m.-5:00 p.m. on Saturdays, and no <br />Sundays. <br /> <br />Mr. Goodrich stated that he is not sure the City can restrict Waste Mana9ement <br />from transporting fill over public thoroughfares; they own the property and <br />the fill is on it. <br /> <br />Commissioner Deemer stated that if Waste Management is willing to sign the <br />agreement with that oondition, then it is legal and bindin9 on both parties. <br /> <br />Page 7 of 10 <br /> <br /> <br />
