<br />The zor, ing officer shall forward copies of the application to the
<br />Plar, r, ir~g Commission ar, d City Council for review and approval.
<br />
<br />The Plar~ning Comlission shall conduct a public hearing on the
<br />cor~ditional use application and shall give at least I0 days
<br />~nailed ~otice to property owr~ers withir, 350 feet of the outer
<br />boundaries of the property in question. Ten days published
<br />~,otice in the official newpaper shall precede the hearing. Any
<br />person ~nay appear and testify at the hearing either in person or
<br />by duly authorized agent. The Planning Comlission shall forward
<br />its fir, dings on the applicatior, to the City Council within 30
<br />days of the public hearing unless the petitioner agrees in
<br />writ ir, g t¢, a tinge extension.

<br />The City Council shall review the application and fir, dings of the
<br />Plar~r, ir, g Com~issior, and shall act upon said application within 30
<br />days after receipt from the Planning Commission. If the City
<br />Council denies the application, that action shall be the City's
<br />fir, al ad~ir, istrative act ion or, the application.
<br />
<br />If the City Council approves the application, as a condition of
<br />that approval, the Council ~ay attach such conditions as it deer, s
<br />r~ecessary, ir~cludinq the duration of the conditional use perr~it.
<br />All development, constructior, and use, shall be ir, accordance
<br />with the approved plan and conditions required by the City
<br />Council. Any development not ir, accord with the approved plan
<br />and conditions shall constitute a violation of this chapter. The
<br />cor~ditions imposed shall be i~posed only in order to protect the
<br />public health, safety, cor~venience, and welfare or to avoid
<br />traffic congestion or hazard, or other dangers, or to
<br />conforr~ity of a proposed use with the character of the adjoining
<br />property and uses, and the district as a whole, or to protect
<br />such character.

<br />In approving or disapproving the application, the City Council
<br />shall adopt written findir~gs detailing the reasons for its
<br />act i

<br />In ;,~akir, g the determination of whether or not the conditior, al use
<br />is to be allowed, the City shall consider the following:
<br /> a. The nature of the land upon which the use is to be
<br /> 1 coat ed;
<br /> b. The nature of adjoining land or buildings;
<br /> c. The proxi~ity of a sin~ilar use;
<br /> d. The effect upon traffic into and fro;~ the pre~,~ises,
<br /> nr to any adjoining roads;
<br /> e. The total number of si~,~ilar uses within the City;
<br /> f. Whether or not the use will be unduly dangerous or otherwise
<br /> detrimental to persons residing or working i~ the
<br /> vicinity of the use, or to the public welfare, en~d-
<br /> .q whether or not ~this use will
<br /> adversely i~,~pair the use, enjnymer, t or market value
<br /> of any surroundinq property.
