9. ~he City Oouncil shall consider the application for rezoning <br />pursuant to Section ~ and shall approve, postpone, or <br />disappr~e the application for the rezoning. If the application <br />for rezoning in approved, the City Council .shall approve or <br />modify and approve the preliminary site plan. <br /> <br />10. ]he developer shall file final plans in accordance with the <br />requirements in Section with the zoning officer at least <br />thirty days before a City Oouncil meeting. <br /> <br />11. ~he City Council, upon receipt of the final plans may approve <br />the final plans if, in their determination, the proposed <br />development is consistent with the preliminary site paln, as <br />approved. <br /> <br />If the applicant proposes major changes in the final site plan <br />that are inconsistent with the preliminary site plan, these <br />changes can only be made by resukmission of a new preliminary <br />site plan and rezoning application to the zoning officer, and <br />rescheduling of a new public hearing before the Planning <br />C(m~i~i~ and re~iewal again by the City Gouncil. <br /> <br />~he following constitute major d~anges: <br />1. Increase in denA_{ ty; <br />2. ~hange in architectural design or style; <br />3. (hange in type of ownership, private, oondiminiu~, or rental; <br />4. (hange of more than 10% in total floor area; <br />5. Increase in height of any building; <br />6. Major modification in the landscape plan; <br />7. Reduction in the proposed open space; <br />8. fhange in the develo~ent schedule; <br />9. ~hange in the road location or standard; and <br />10. Any changes determined to be major by the City <br /> <br />MINOR ~ <br />~e City Gouncil may, in its discretion, permit minor deviations <br />fr~m the preliminary site plan which do not change the concept or <br />intent of the proposed development as pre~iously appr(wed. <br /> <br />DENIAL <br />~he City Council shall deny any application if it finds the final <br />plans do not substantially conform to the preliminary site plan <br />as pre~io,,~ly approved by the City Council. If the final plans <br />are subsequently modified to conform to the approved preliminary <br />plan, the applicant may resubmit said final plans to the City <br />Council for approval. <br /> <br />1. If final plan approval is not granted within a two year <br />period from the time the City Council approved the rezoning and <br />preliminary site plan, the Council may initiate a rezoning to <br />remove the Planned Unit Development District zoning and rezone <br /> <br />I-3 <br /> <br /> <br />
