The purpose of this section is to Provide the City of Ramsey with <br />an op~ortun/ty for relief fr~m unneoessary harc~hipe <br />resulting from the rigid enforcement of its broad zoning <br />ordinance. This variance provision authorizes the Board of <br />A~justment to pemit a particular property to be used in a manner <br />forbidden by the chapter by varying the terms of the chapter. <br /> <br />The Board of Adjustment, upon appeal, shall have the power to <br />authorize variances from certain requirements of this chapter. <br />Variances shall pertain only to the physical characteristics of <br />the land or strucutres to be built thereon, such as area, height, <br />extent of lot coverage, setback requirements, density, and <br />parking requirements. Specifically, the Board of Adjustment may <br />grant only non-use or area variances and may not grant use <br />varia~ces. <br /> <br />No variance in the provisions or requirements of this chapter <br />shall be authorized by the Board of Adjustment unless it finds <br />evidenoe that ali the following facts and conditions exist: <br /> a. That there are exceptional, unique, or extraordinary <br /> circ~stances or oonditions applying to the property <br /> in question as to the intended use of the property that <br /> do rmt .apply generally to other Properties in the dis- <br /> trict; <br /> b. That such variance is necessary for the preservation <br /> and enjoyment of a substantial property right similar <br /> that possessed by other properties in the same <br /> vicinity. The possibility of increased finanicial <br /> return shall not in itself be ~med sufficient to <br /> warrant a variance; <br /> c. That the special conditions or circumstances do rmt <br /> result from the actions of the applicant. <br /> d. That the granting of the variance requested will not <br /> grant the applicant any special Privilege that is <br /> denied by this chapter to other owners of lands, <br /> structures or buildings in the same district. <br /> e. That the variance requested is the minimu~ variance <br /> which would alleviate the hara~hip. Economic con- <br /> siderations alone shall be considered a hardship. <br /> f. That the variance will not be materially detrimental <br /> to the purposes of this chapter, or other property in <br /> the same zone. <br /> g. That the varianoe will not substantially increase the <br /> congestion of public streets, or increase the danger <br /> of fire, or endanger the public safety, or substan- <br /> tially impair p~operty values within the neighborhood. <br /> <br />In granting a variance, the Board of Adjustment may impose <br />conditions to insure compliance and to protect adjacent <br />properties. <br /> <br />Within 60 days after receipt of filing of a request for a <br /> <br />C-9 <br /> <br /> <br />
