variance or an appeal from an administrative order or <br />dte~ination, the Board of Adjustment shall hold a public hearing <br />thereon, and ahall hear such persons as wish to be heard, either <br />in person or by agent or attorney. Notice of such hearing sha/1 <br />be published in a newspaper of general circulation at least 10 <br />days prior to the date of the hearing. In addition, notice of <br />such hearing shall be mailed not less than 10 days before the <br />date of hearing to the person or persons who filed the appeal or <br />request, and in the case of a request for a variance, to each <br />owner of property situated wholly or partly within 350 feet of <br />the property to which the variance relates. A map containing the <br />na~es and addresses of property owners within 350 feet of the <br />property whereon the variance is requested shall be su~itted <br />with, and made a pmrt of, the application for variance. <br /> <br />Within a reasonable time after the hearing, the Board of <br />Adjustment shall make its order deciding the matter and serve a <br />copy of such order upon the appellant or the petitioner by mail. <br />This shall be the final action of the City on the variance <br />application. <br /> <br />All costs incurred bf the City in processing an application of a <br />conditional use permit, special use permit, site plan review, <br />or variance shall be paid by the applicant. Said costs shall <br />include but not be limited to.. professional consulting services <br />as directed by the Planning Commission, Board of Adjustment, <br />and/or City Council, copying charges, extraordinary City staff <br />involv~ent, public hearing publications, and written notice to <br />adjacnet property owners. A set fee established from time to <br />time by the City (buncil shall be deposited with the City at the <br />time the respective application is made. At the time the <br />application is made, if the Zoning Officer determines that costs <br />in addition to the set fee will likely be incurred by the City, <br />then an additional su~ as determined by the zoning officer shall <br />be deposited with the City. Any portion of those funds deposited <br />but not expended shall be returned to the applicant after final <br />action on the application. <br /> <br />C - 10 <br /> <br /> <br />
