~e City Council shall act as the Board of Adjustment and shall <br />elect a chai~nan and vice-chairman and appoint a secretary. It <br />shall hold meetings, keep minutes and, pursuant to notice, shall <br />conduct hearings, take testimony under oath, and render decisions <br />in writing within 45 days after the hearing or continued hearing. <br />A fee shall be charged in accordance with a schedule annually <br />affixed by resolution for any appeal or proceeding filed with the <br />Board of Adjustment. <br /> <br />~e Board of Adjustment shall have the power to hear and decide <br />appeals from any order, requirement, decision, grant, or refusal <br />made by the zoning officer in the administration of this <br />ordinanoe. An appeal shall be in writing and filed in duplicate <br />with the zoning officer. Within 10 days after filing of the <br />appeal, the zoning officer shall transmit to the Board of <br />Adjustment all p~pers involved in the proceedings. Upon receipt <br />of this material, the Board of Adjustment shall set a hearing <br />date and give notice by mail of the time, place and purpose <br />thereof to the appellant and to the zoning officer. The Board of <br />Adjustment may reverse or affirm wholly or in part any ruling, <br />decision, or determination of the zoning officer and may issue or <br />direct the issuance of a permit. The decision of the Board of <br />Adjustment may be appealed to the District Gourt. <br /> <br />Enf or cement/Penal ti es <br /> <br />Any violation of this chapter may be enjoined by the City <br />Council through proper legal channels. Each day a violation is <br />permitted to exist shall constitute a separate offense. <br /> <br />In case any building, structure, or land is proposed to be <br />erected, reconstructed, altered, converted, maintained or used <br />in violation of this chapter, the City Council, in addition to <br />other remedies, may institute in the name <br />of the City of Ramsey any appropriate action or proceeding to <br />prevent, restrain, correct or abate such building, structure, or <br />land, or to prevent, in or about such premises, any act, conduct, <br />business, or use constituting a violation. <br /> <br /> <br />
