Goodrich, City Attorney <br />Ramsey Ordinance # 86-8 known as "Public Improvememts~ <br />Special Assessments" <br />February 13, 1985 <br /> <br /> Pursuant to your request, this memo is being written to <br />compare Ramsey Ordinance 84-8 to Chapter 429 of Minnesota <br />Statutes. <br /> <br /> Ramsey Ordinance 86-8 is Ramsey's ordinance which regulates <br />the construction and financing of local improvements. This <br />ordinance was adopted pursuant to the directive of Chapter 8 of <br />the City Charter. Ordinance 86-8 is known as Chapter 210.01 of <br />the City Code and will hereafter be referred to as "Chapter <br />210". <br /> <br /> Chapter 429 is the state laws which regulate local <br />improvements for statutory cities. Prior to its City Charter, <br />Ramsey did follow Chapter 429. <br /> <br /> The most obvious difference between Chapter 210 and Chapter <br />429 is the lengthening of the time frame it takes from the <br />commencement of an improvement project through the time bonds are <br />sold.' Section 210 requires that the nottce of the first <br />improvement hearing be published in the City's Newsletter. <br />Currently this newsletter is being published every other month. <br />Chapter 429 permits publication in the City's official newspaper, <br />which is published weekly. <br /> <br /> Chapter 210 requires a 60 day waiting period between the <br />improvement public hearing and ordering of the improvement by the <br />Council. Chapter 429 allows ordering of the improvement <br />immediately after the improvement public hearing. <br /> <br /> The purpose.of the 60 day waiting period above described is <br />to allow a period of time in which the proposed benefited <br />property owners can petition for or against the improvement° If <br />within the 60 day period a petition against the improvement is <br />filed with the Council, which petition is signed by a majority of <br />the benefited property owners proposed to be assessed, or if an <br />opposing petition is signed by as many persons who petitioned for <br />the project, the Council cannot finance the improvement by <br />special assessment. Chapter 429 does not provide for this <br />petitioning process. <br /> <br /> <br />
