I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i <br />I <br />I <br />I <br />I <br />I <br />i <br /> <br />- 2 - <br /> <br /> Section 210 provides that when less than 80 percent of the <br />estimated cost of a local improvement is to be paid for by <br />special assessment, within the above described 60 day period <br />after the improvement public hearing, a petition may be filed by <br />a number of voters greater than 50% of the number of registered <br />voters at the last City wide election, protesting the improvement <br />and/or financing method. When such a petition is filed, the <br />Council cannot then proceed with the project. Such a provision is <br />not contained in Chapter 429. <br /> <br /> Chapter 210 provides that in the event an improvement has <br />been allowed, but the lowest bid exceeds the engineer's estimated <br />cost by ten (10%) percent, the improvement cannot go forward and <br />the whole process has to be started over. Chapter429 has no <br />such provision. <br /> <br /> Chapter 210 provides that when a project has been turned down <br />because of the above provisions, it cannot be reconsidered within <br />a period of one (1) year from the date of the improvement public <br />hearing. Chapter 429 has no such provision. <br /> <br /> Chapter 210 requires a public hearing even when 100% of the <br />proposed benefited property owners petition for the improvement. <br />Chapter 429 does not require a public hearing in such an <br />instance. <br /> <br /> Chapter 210 provides that in the event the Council <br />determines to make a local improvement, it must let the contract <br />for the work within one (1) year of the improvement public <br />hearing. Chapter 429 does not have such a provision. <br /> <br /> With the exception of the above provisions, Ramsey Code <br />Chapter 210 and M.S. Chapter 429 are substantially similar. <br /> <br /> <br />
