Legislative Commission on Waste AAanagem
EI46 ~,TATE CAPITOL ,~T. PAUL. h41NNE~OTA 55155 ~ - .

City Admini ·
strator ~V-~- · Vx~
City of Ramsey
15153 Nowthen Boulevard Northwest
Ramsey, F~q 55303

Dear Mr. Schnelle:

I am writing in response to the question you raised yesterday
regarding use of the revenues from the fee levied by the City of
Ramsey at the Ramsey Landfill. You asked whether the city could
use the proceeds of the fees to enhance the city general fund by
the amount of tax dollars which were lost due to depressed property
values arround the landfill. Minnesota Statutes 115A.921 provides
that "The Revenues from the fees shall go to the city or town
general fund for purposes of mitigating and compensating for the
local risks, costs and other adverse effects of facilities."
The particular use of the fee which you described was not discussed
when the law was being debated in the Legislature, but it does
not appear to be precluded. However, since I am not an expert in
town law there may be other relevant parts of the statutes that
would affect this. Therefore, I would suggest you ask your city
attorney for an opinion on this matter or you may want to consider
asking the State Attorney General for an opinion.

I hope this information is useful. If I can be of further
assistance, please feel free to contact me.

Sincerely,

Susan Robertson
Director, LCW}~

SR/may

Rep.
