I
I
I
I
I
I
I
I
I
I
I
I
I

MEMO

TO: City Council

FROM: City Staff

DATE: May 9, 1985
RE:

Recommendation on Norm Holm's Request for MSA Ri~ht-of-Wa¥ and
Grading Payment

In review and discussion on Mr. Holm's request, additional facts have
been brought to our attention. At the time that the developer agreed
to the location of the MSA street through his development, the City
policy of assessing MSAS had not been adopted. Therefore, the
developer agreed to donate the R.O.W. provided the City would con-
struct the MSA street without any assessments.

Based on the recent bids, the assessments on the MSAS for the first
phase of Flintwood Hills 2nd Addition amounts to $12,300 and the
future assessment would equal $5,800 for the second phase.

As an alternate recommendation, in lieu of the fact that the MSAS
through Flintwood Hills 2nd was established prior to the assessment
policy, the City could compensate Mr. Holm based on past projects.
This compensation would be as follows:

Grading 23,000 C.Y. at $1.44/C.Y.~ = $33,120
Muck excavation 800 C.Y. at $2.00/C.Y. =~ ........ i~-i-~~
TOTAL COMPENSATION t~''=~$34, 720 /-~

The above alternate would not include compe~-~'t~i~o~'for R.O.W. or tree
removal. However, it would not provide for any assessment to th~
developer. ~
