I <br /> I <br /> I <br />I <br />I <br /> ! <br />! <br />I <br />I <br />i <br />I <br />I <br />i <br />I <br />I <br />I <br />! <br /> <br />Councilmember <br />findings of fact <br /> <br />made the motion to adopt the following <br /> <br />PROPOSBD FINDINGS 0F FACT <br /> <br />1. That the Applicant has properly applied for a Board of <br />Adjustment variance to oonstruct an addition which will encroach <br />on the required front yard setback. <br /> <br />2. That the Applicant appeared before the Board of Adjustment <br />for a public hearing on June 25, 1985, and that said public <br />hearing was properly advertised and that the minutes of said <br />public hearing are hereby incorporated as a part of these <br />findings by reference. <br /> <br />3. That the subject property is generally known as 6259 144th <br />Avenue N.W., Ramsey, Minnesota, and is legally described as Lot 3 <br />Block 1 Hunters Hill. <br /> <br />4. That the subject property is located in an UER Urban Existing <br />Residential District. <br /> <br />5. That the Applicant's request is to construct an attached <br />garage with full basement to the existing structure. <br /> <br />6. That the City Code requires a front yard setback of 40 feet. <br /> <br />7. That the proposed garage will encroach on the front yard by <br />approximately 18 feet, leaving a front yard of approximately 22 <br />feet. <br /> <br />8. That due to the geometrical shape of the subject property, <br />there are exceptional, unique or extraordinary circumstances or <br />conditions applying to the subject property as to the intended <br />use of the property that do not apply generally to other <br />properties in the same zoning district. <br /> <br />9. That such variance is necessary for the preservation and <br />enjoyment of a substantial property right similar to that <br />possessed by other properties in the same district and in the <br />same vicinity. The possibility of increased financial return <br />shall not in itself be deemed sufficient to warrant a variance. <br /> <br />10. That the authorization of such variance will not be of <br />substantial detriment to adjacent property and will not <br />materially impair the intent or purpose of this ordinance or <br />public interest. <br /> <br />11. That the condition or situation of the subject property, or <br />the intended use of the property for which the variance is <br />sought, is not of so general or recurrent a nature as to make <br />reasonably practicable the formulation of a general regulation <br />for such conditions or situation. <br /> <br /> <br />
