Voting yes:

Voting no:

Item El [~!led On-sit? 5eptSp~ Systeml Case of Ms. Carol Bryantl

In February of this yetr, we received a complaint that an on-site
septic system was discharging onto the street. In making ar,
inspectior,, we confirmed that this was in fact true. We immediately
sent the homeowner a notice to have the system pumped and directed
that the system be upgraded when weather conditions permitted. The
homeowner is now appealing that directive, as she indicates there
have r~ot been any further problems, which there have not. However,
our concern is how the syste~n ~ill function this winter.

Er, closure (D2-v) contains the homeowner's appeal dated June 20, 1985,
our letter of February 14, 1985 and a copy of the City Ordinance
regarding this matter.

Council Action:

If you choose to grant Ms. Bryant's request, then you should
stipulate that any violations in the future will require immediate
repairs regardless of the time of year. The following proposed
motion is hereby submitted for your consideration:

Motio~ by and seconded by to approve
of Ms. Carol Bryant's appeal to the Director of Technical
Services' directive dated February 14, 1985 which will allow her
to continue using the on-site septic system as it is until such
time as other problems arise, and further, that any future
problems will require immediate installation of an on-site
septic system in compliance with the present code.

Further discussion:

Motion carried/failed.
