In original form, it indicates that ... <br /> [T]he keeping of any pet on the Property shall be restricted according <br /> to provisions of the Association's Rules and Regulations as amended by <br /> the Board of Directors from time to time; provided, however, in no case <br /> may any type of fish, fowl or animal be bred, kept or maintained for <br /> commercial purposes on the property. <br /> When this Declaration was adopted in 1993, the City of Ramsey similarly had an <br /> ordinance that restricted farm animals from being on residential property. <br /> However, effective June 12, 2012 the City of Ramsey amended their ordinance to <br /> allow chickens on property smaller than 3 acres, subject to certain conditions. In <br /> response to this, the Board amended the Rules and Regulations of Northfork on <br /> June 12, 2012 to restrict the ownership and possession of any livestock, whether <br /> commercial or personal in use, on property within Northfork at any time. This <br /> topic was raised at a regular Board meeting on Thursday, March 26, 2015 and <br /> the Board's decision was reaffirmed. <br /> In early October 2016, it came to the Board's attention that the Harers had <br /> a chicken coop and were housing chickens on their property. The Board <br /> contacted the Harers via correspondence on October 10, 2016 and raised two <br /> issues. First, the Board reminded the Harers that pursuant to Article IX of the <br /> Declaration any building or placement of a structure on property within <br /> Northfork is not to be commenced unless and until the plans and specifications <br /> for the structure have been approved by the Architectural Review Committee. The <br /> Board requested that the Harers remove any unapproved structure from their <br /> property. Secondly, the Board informed.the Harers about the Board's <br /> amendment to the Rules and Regulations restricting any livestock from property <br /> within Northfork for commercial or personal use. The Board requested that the <br /> chickens at the Harer property be removed. <br /> In response to this written request, as well as oral conversations between various <br /> Board Members and the Harers, the Harers made a formal complaint to the City <br /> of Ramsey Police Department.
