Anok a~ Minnesota 55303 August 18~ 1978 Dear Mayor Cox: On January 11, 1978, Cormmissioner of Natural Resources, William B. Nye, signed a designation order which provided for the inclusion of the Rum River as a component of the Minnesota Wild and Scenic River System. As required by Minnesota Statute, Section 15o0412~ all rules must be reviewed by the Attorney General and printed in the State Register. The above requirements have been accc~nplished and the Rum River designation (.Ntt 2700-2720, copy enclosed) became effective on March 20, 1978. The Commissioner based his decision to designate the Rum River on the recon~nendations of the State Hearings Ex~niner, follo:~-ing the five public hearings held last August and review of all the testimony received. A copy of the Hearing Examiner's report is available from this office on request. l~innesota Statute, Section 104.36~ states in part that: "Within six months after establishment of a wild~ scenic or recreational river area~ each local goverr~nent containing any portion thereof shall adopt or ~mend its local ordi- nances and maps to the extent necessary to comply with the standards and criteria of the commissioner and the management plan". In the case of the Rum River, this statute requires that all ordinance ~nendment work be completed by no later than September 20~ 1978. To date, I am not aware of the City of Ramsey adopting the appropriate land use regulations outlined in the rules and regulations (NR2700-2720) In addition, the Metro Region (Region VI) Waters staff has been assigned the ] implementation of the municipal shoreland and flood plain progra~ms. Minnesota 'ii~..i Statute 105.485 requires each community having shorelands within ..its corporate ~:~ limits to amend its existing ordinances within one year after the Con~m. issioner of Natural Resources notifies the community its existing ordinance(s) are not compliant v~th Standards and Criteria for the Manao~ement of Shoreland Areas of Minnesota (copy enclosed). This will require the City of Ramsey to submit all existing zoning~ subdivision, and other development related ordinances/codes to this office within 30 days from the date of this correspondence for our review for compliance. I have enclosed the preliminary municipal shoreland classification data for those public water basins and water-courses which will require regulation within a municipal shoreland ordinance. I have also enclosed suppl~nentary reports (No'd l~ 5, and 6) and a number of model ordinances which explain the municipal shoreland program. Within 60 days from the date of this correspondence~ the city should review these preliminary lake classifications and submit any requests f.or reclassification to this office. Within this 60 day time frame, this office ~11 review the city's'existing regulation for compliance with the municipal shoreland standards and notify the city of all areas of noncompliance.
