They said they were told they would be
assessed for seven units, and they never heard about it until after it was
all finished.

Engineer Raatikka asked them if they had any questions about it.

Mrs. Schwaab said she came to find out what this hearing was all about.

Mayor Gamec explained how the street project started with a petition
being presented by the property owners and that it is the City's policy
that there has to be at least 60 percent or better of the property owners
in favor of blacktop. The bonding agency brought up the fact that there
was a street called Neon in the project and the City wasn't aware of it
because it turns into 170th Lane, all in one road, and some of the records
on addressed on file in the City Assessor's office were incorrect. It was
an error that was made and through changing the name of the streets etc.,
it was necessary to rehold the public hearing.

AMENDMENT TO CITY CODE

Amendments to the Code were tabled until October 22, 1979 Council meeting.

VACATING OF PROPERTY LOCATED IN FLINTWOOD II

Motion by Councilman Reimann and seconded by Councilman Cox to vacate
the easement located in Flintwood Hills II and the City. The City cannot take over the ditch but
they will look into abandoning it, there is some problem due to the ditch
taking water from the area to the north. The developer should present a
proposal as to how he is going to change it and they will look at it and
see how it~affects people to the north. If it does begin to work the City
has to hold a public hearing in case it does eliminate some slews, ponds, etc.,
that people may want to keep.

Administrator Schnelle added that the City has to approve of what the developer
is going to do.

Mayor Gamec said the drainage would be lessened considerable when storm sewer
is installed.

Attorney Goodrich said the developer should be instructed to bring in a plan
and the City will look at it and how it will affect the surrounding property
owners.

R~gular Council Meeting - Sept. 24, 1979
Page 5
