Mr. Marston suggested a first step could be to have a reference in the <br />subdivision ordinance on these standards. And that when someone comes into <br />the City for a building permit they should provide whatever was submitted at the <br />time the plat was laid out: what did they anticipate doing with the run off, <br />tree cutting. ~nformation provided at the time of the plat approval should be <br />provided with the building permit application. <br /> <br />Chairman Peterson said a].~copy of the covenants could be filed at the City and <br />at the time of the application, this information could be provided by the City. <br /> <br />Art Dunn asked what would the City doD for, instanc~ to a person who changes <br />the grade? <br /> <br />Mr. Marston said the ordinance would prohibit someone from doing .that. <br /> <br />Art Dunn said that if someone is going to screw up his land, he will, and <br />there are very few courts of law that will do anything about it. <br /> <br />Mr. Marston said he disagrees. <br /> <br />Ron West feels that a person should be able to alter the location of his home <br />placement if he comes in and offers alternatives to the %6cation established <br />on the plat. <br /> <br />Art Dunn said that house placement' is not that imperative because we have setbacks <br />already and assume that he will cut down only those trees necessary for the <br />building of the house. <br /> <br />Mr. Marston asked if he did not care if he builds on slopes or if he cuts down <br />trees. He said we are trying to identify standards. <br /> <br />Art Dunn asked what would be the result of violations of the permit· <br /> <br />Attorney Goodrich stated that if the offense is serious enough'~we .would get an <br />injunction and court order to Stop the offender. <br /> <br />Attorney Goodrich said that the permit system will be the same as the preliminary <br />plat procedume. <br /> <br />Ben Deemer said the building inspector can pull out the plat and see what is <br />required for each lot, and exempt all the lots within the subdivision from obtaining <br />individual environmental permits. <br /> <br />Gerald Zimmerman said that five acre pieces or more would have to go through <br />the whole process. <br /> <br />Jim Martin asked if it is necessary to go into 170.0112F, Item!.S~.and 6 regarding <br />soil reports, plant types and species etc. <br /> <br />Attorney Goodrich replied ye% because we db not have any watershed information <br />and should not allow tampering with the land areas until these studies are done. <br />No filling of wetland or building on wetland until drainage 'studies have been <br />completed. <br /> <br />Discussion held regarding placing of a moritorium on the wetland lots until the <br />storm water drainage study is done.
