Councilman Reimann said City Assessor Wirz said the whole parcel is not being taxed convnercial. Councilman Mickelson said everything 200 feet back is taxed co~mnercial. Councilman Cox said Item #5 of the findings is not correct as the ordi- nance requires three (3) acres per horse. It was agreed that Item #5 relates to the ordinance as it existed in 1977, and that the findings should be amended to specifically state this. Councilman Cox said he didn't agree that this is a "grandfathered" in business, and that the only one on the Council who has a "grandfathered" in business is Councilman Reimann. Attorney Goodrich said the issue is not Councilman Mickelson~s business but rather the accessory building. Councilman Cox said he doesn't agree that this is not the expansion of a business. City Administrator Schnelle said there have been no complaints about Councilman Mickelson's operation. Councilman Cox said he feels it is not unusual for the public to not com- plain about business. Councilman Cox said that on a similar application on County Road #5 or Ramsey Blvd. the City denied the application. Motion by Mayor Gamec and seconded by Councilman Reimann to adopt the proposed findings of fact with the clarification of Item #5 as above men- tioned, to direct that a building permit be issued upon payment of the proper fee to Councilman kaickelson in order to complete the building, and that there will be no storage of business related material in the building nor storage of non related business materials which have been removed from an existing building in order to create additional space for business related materials. Motion carried. Voting yes Mayor Gamec, Councilmen Reimann and Sorteberg. Voting no Councilman Cox. Councilman Mickelson Abstained. CITY ENGINEER a) Landfill Meeting - City Engineer Raatikka reviewed his April 22, 1980 report on this subject with the Council. Councilman Cox said some items of the report require immediate action. Specifically he referred to Item #4, and also that the required quarterly reports have not been received. Mayor Gamec said Comprehensive Health is supposed' to be handling these matters. Councilman Cox said there are flagrant violations existing and these matters cannot slide by. City Administrator Schnelle said he would call Comprehensive Health and that the reports will be sent. Councilman Cox asked also if we could request a rate increase, City Attorney Goodrich said this could be done because there is an existing contract with the Landfill operator. However, the Attorney said if the management is breaking the contract, then perhaps a new contract could be negotiated. C/April 22, 1980 Page 10
