I <br /> <br />I <br />I <br />I <br />I <br />! <br />I <br /> <br />Some discussion ensued as to when Mrs. Schindeldecker ~urchased the property <br />and when the Comprehensive Plan was adopted. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner ~aDue to ~eQommend <br />that Council approve the findings of fact for Mrs. Marlys Sehindmldeeker's <br />request to subdivide by metes and bounds, with the following corrections and <br />additions: <br /> <br />1. Change Item #5 to read: "That the CounciI policy has generally been to <br /> require platting of all subdivisions." <br /> <br />2. Add Item #6: The subject property is a parcel resulting from subdivision <br /> of the property in the past. <br /> <br />35 <br /> <br />Add Item #7: Subdivision of. this property would result in densities <br />of one dwelling per 2% acres, which is less than surrounding (properties <br />located in Whispering Pines) density of one dwelling per acre. <br /> <br />4. Add Item #8: <br /> of land. <br /> <br />5. Add Item #9: <br /> <br />That there is an existing dwelling on the subject tract <br />153rd Avenue NW is an MSA street. <br /> <br />Further Discussion: Commissioner Dunn suggested added the following as Item #10 <br />to the findings of fact: <br /> <br />! <br /> <br />I <br />I <br />I <br />I <br /> <br />6. Add Item #10: Subdividing the subject property would meet the mimimum <br /> lot size of 2% acres requirement, but not the density requirement. <br /> <br />Commissioner Deemer amended his motion to include the addition of Item ~10 to <br />the findings of fact. Commissioner LaDue seconded the amendment to the motion. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Dunn, Zimmerman, <br />Deemer, Isakson, Schneider and LaDue. Voting No: None. <br /> <br />Motion by Commissioner Dunn and seconded by Commissioner LaDue to recommend <br />that Council approve Mrs. Marlys Schindeldecker's request to subdivided by <br />metes and bounds based on the findings of fact and that the recommended <br />subdivision would meet the minimum lot size reqUirements and that the addition <br />of one structure or increasing the density by one will not have any adverse <br />affect on the development'of the City or present any health hazards to the <br />citizens. <br /> <br />Motion failed. Voting Yes: Commissioners Dunn, LaDue and Schneider. Voting <br />No: Chairman Peterson, Commissioners Isakson, Deemer and Zimmerman. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Isakson to recommend <br />that Council deny Mrs. Marlys Schindeldecker's request to subdivide by metes <br />and bounds based on the findings of fact. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Isakson, Deemer <br />and Zimmerman.
