4.5 Line Extension Requirements. <br /> 4.5.1 Subject to subsection 4.3 above, the Grantee shall make Cable Service available <br /> to all Qualified Living Units within the City, including multiple dwelling unit <br /> buildings except for multiple dwelling unit buildings to which the Grantee, <br /> after best efforts, has not obtained authorization to access. <br /> Grantee shall have a line extension obligation a reasonable time after the first date <br /> by which Grantee is providing Cable Service to more than fifty percent (50%) of <br /> all subscribers receiving facilities based Cable Service from both the Grantee and <br /> any other provider(s) of Cable Service within the City based on such Subscriber <br /> count information as City may possess, including information available to the <br /> City on a trade-secret or non-public basis. At that time, the City, in its reasonable <br /> discretion and after meeting with Grantee, shall discuss the timeframe to complete <br /> deployment to the remaining households in the City subject to a Line Extension <br /> requirement that is the same or similar to the requirement of the incumbent <br /> franchised cable operator. <br /> 4.5.2 Within the City's boundaries, including any areas annexed after the Effective <br /> Date of this Franchise, the Grantee must provide Service to a Qualified Living <br /> Unit upon request. <br /> 4.6 System Maintenance. <br /> 4.6.1 The Grantee shall interrupt Service only for good cause and for the shortest time <br /> possible. Such interruption shall occur during periods of minimum use of the <br /> System. The Grantee shall use its best efforts to provide the City with at least <br /> twenty-four (24) hours' prior notice of a planned service interruption, except for a <br /> planned service interruption which will have a minimal impact on Subscribers, <br /> usually meaning affecting less than one hundred (100) Subscribers or less than a <br /> fifteen(15)minute interruption. <br /> 4.6.2 Maintenance of the System shall be performed in accordance with the applicable <br /> technical performance and operating standards established by FCC rules and <br /> regulations. Should the FCC choose to abandon this field and does not preempt the <br /> City's entry into this field, the City may adopt such technical performance and <br /> operating standards as its own,and the Grantee shall comply with them at all times. <br /> 4.7 System Tests and Inspections; Special Testing. <br /> 4.7.1 Grantee shall pet-faun all tests necessary to demonstrate compliance with the <br /> requirements of the Franchise and other performance standards established by law or <br /> regulation. <br /> 4.7.2 The City shall have the right to inspect all construction or installation work <br /> performed pursuant to the provisions of this Franchise. In addition, the City may <br /> require special testing of a location or locations within the System if there is a <br /> particular matter of controversy or unresolved complaints regarding System <br /> construction, operations or installation work pertaining to such location(s).
