CITY OF RAMSEY AGREEMENT TO GUARANTEE COMPLIANCE WITH DEVELOPMENT CONDITIONS ESTABLIS~LED BY THE CITY OF RAMSEY BETWEEN Morrell Trucking, herein after referred to as "Applicant" and the City of Ramsey herein after referred to as "City". INTENT AND PURPOSE This agreement is to assure that the conditions of approval established by the City of Ramsey for all commercial and industrial developments are understood between the Applicant and the City, and that the Applicant complies with said conditions fully within the time frames established by this agreement. This agreement acknowledges the Applicant ham made 'the proper application for the approval granted by this agreement and has met all other conditions established by the Planning and Zoning Commission and City Council. Legal Description of Property: Lot #1, Block 2 Gateway North Industrial Park General Location: Property Add~ess -- 14050 Azurite Street N.W. Zoning Classification: I-1 Approved Use of Property: Truck Terminal CONDITIONS OF AGREEMENT 1) Applicant shall submit to the City eleven (11) copies of the final site plan which conform to all City of Ramsey conditions of approval. Applicant shall complet.e and occupy his building or facility and all landscaping and other site work as per the stamped approved final site plan no later than October 1, 1980. Applicant shall deposit with the City a cashier's check, irrevocable letter of credit, performance bond, or other suitable secztrity accept-' able to the City in the amount of 150 percent (150%) of the cost of completing all landscaping improvements, asphalt parking and driveway, outside lighting, curbing, wood mulch and marking of fire lane to in- sure access to the building for fire 'fighting equipment. In addi- tion the bond or escrow amount shall be in an amount sufficent to guarantee two (2) full growing seasons following the installation of landscape plantings as shown on the approved site plan attached hereto as Exhibit "A".
