CITY OF RAMSEY <br />CITY' COUNCIL <br /> <br />FINDINGS OF FACT re David Mickelson <br /> <br />1) Assessment records indicate ~. Mickelson has owned the property located <br />at 16121 Ramsey Blvd. since 2966. His initial residence was located at 26121 <br />Ramsey Blvd. on 5.37+ acres of land in two separate parcels, <br /> <br />2) On October 27, 1975, Mr. Mickelson applied for and received a building <br />permit to construct a 1,176 square foot accessory building. A sketch of the <br />structure included with the application shows the intended building use as <br />a work area. <br /> <br />3) On August 23, 1976, Mr. Mickelson applied for and receive~a building per-. <br />mit to construct a new residence located at 16101 Ramsey Blvd, N~W, whi'ch is <br />located on the 3.00 acre parcel of land created by property line relocations <br />as described in item number four below, <br /> <br />4) On November 8, 1976, the City Council granted Mr, Mickelson a variauce <br />which relocated an existing subdivision property line~ The resulting parcels <br />are 2.37 acres and 3.00 acres, <br /> <br />5) In the summer of 1977 (.date unknown) Mr. Mickelson purchased for his <br />daughter, a horse. City ordinance requires that horses shall be provided <br />adequate shelter and kept on no less than 2.5 acres, <br /> <br />.6) In the fall of 1977 (date unknown) Mr. Mickelson commenced construction <br />of the lower portion of a new accessory building as a shelter for his horse~ <br />The Building Official at that time determined that the' shelter'did not exceed <br />$500 in valuation and, therefore, no permit was required. Council policy <br />had established that permits were not required for construction where the <br />valuation did not exceed $500, <br /> <br />7) Ramsey's ordinances, at that time, did not regulate the permitted .square <br />footage of accessory buildings. This was controlled by the State Building <br />Code by structure classification. <br /> <br />8) On November 13, 1978, the City of Ramsey amended its ordinance to regu~ <br />late the permitted area of all accessory buildings that was published as <br />Ordinance No. 7944. The permitted areas "square footage'~ is determined by <br />the acreage of the property upon which the accessory building is to be <br />located. On August 28, 1978, the Council passed a 60 day moratorium on the <br />issuance of accessory building perits. After that date, until adoption of <br />the Ordinance on November 13, ~978, the Council acted on each accessory use <br />permit. It therefore, appears there were no formal regulations affecting <br />accessory use buildings except building permit requirements~ in effect in <br />the fall of 1977. <br /> <br /> <br />
