City Administrator's Comments: After hearing this case at <br />the Board of Adjustment public hearing on March 25, 1980, <br />I noted that there might be a difference in use for th_is pro- <br />posed accessory building. It was stated to the Board of <br />Adjustment that bee keeping equipment would be kept in this <br />proposed building. Consequently, if this the case~ we could <br />have a business operation which would be in violation of the <br />zoning ordinance and your accessory building ordinance~ When <br />Mr. Owens applied for this accessory building variance <br />he stated it was only for personal storage. <br /> <br />Board of Adjustment Action - The Board of Adjustment will <br />have to take the following action: <br /> <br />a) Finding of Fact - Approve/Disapprove of the Finding of <br />Fact. <br /> <br />b) Granting of variance - The Board of Adjustment will have <br />to Approve/Disapprove of the granting of the variance, <br /> <br />c) Condition of Variance -. We did not attach an agreement to <br />this case. Because if this accessory building is going to be <br />used for storing equipment for a business operation it is in <br />violation of the City Code. In which case Mr, Owens would <br />have to be informed that he would have to apply for a condi-~ <br />tional use permit and this would require him to appear before <br />the Planning and Zoning Commission who would conduct the <br />public hearing for the conditional use permit. The Planning <br />and Zoning Commission wou2d make recommendation approving/ <br />disapproving based on the public hearing to the City Council <br />for their approval/disapproval. After this action was taken <br />then the Board of Adjustment could approve of a variance. <br /> <br /> <br />
