2 70. 019 ~IF.I~MI!NTS <br />] 70. 019A ]kxlI~D/,It-TNTS <br /> <br />The city council may amend this chapter as proposed by a member of the <br />city counci], by the planning commission, or by a petition of a person <br />residing or owning property within tbe City of Ramsey, in accordance <br />with the following provisions: <br /> <br />] 70. 019B PROCEDURE <br /> <br /> 1. Petitions for amendment shall be filed with the planning <br />commission and the petitioner, upon such filing, shall pay an advertis- <br />ing deposit and a filing fee in accordance with a schedule annually <br />affixed by resolution. The planning commission shall review the pro- <br />posed amendment and report its findings and recommendations in writing <br />to the city council and to the petitioner. The proposed amendment <br />shal'l be introduced before the city council only if a member .of the <br />city council elects to do so. If an amendment proposed by petition <br />is not introduced, the advertising depsoit shall be refunded to the <br />petitioner; otherwise such deposit shall be paid to the city. <br /> <br /> 2. Any proposed amendment introduced by a member of the <br /> city counci] without written findings and recommendations from the <br /> planning commission shall be referred to the planning commission for <br /> review at ].east thirty (30) days prior to public hearing by the council. <br /> The city council may not act upon the proposed amendment until sixty <br /> (60) days have elapsed from the date oX. reference of the amendment <br />~report from the planning commission. '~.~,z4'~ <br />~4,~,~/~ 3. Before voting on the enactment of an amendment, the <br /> ~nc-i-~ shall hold a public hearing thereon, pursuant to public notice. <br /> It shall be the responsibility of the zoning officer to have notice of <br /> the time, place, and purpose of the public hearing published in the <br /> official city newspaper ten (10) days prior to the hearing. <br /> <br />Also, when an amendment involves changes in district boundaries affect- <br />ing an area of five (5) acres or less, a written notice of the bearing <br />stating its time, place, and purpose shall be mailed by the zoning <br />officer at least ten (10) days before the day of the bearing to each <br />owner of affected property and property situated wholly or partly with- <br />in thr~e bundred fifty (350)feet of the property to which the amend- <br />ment relates. For the purpose of giving mailed notice, the zoning <br /> <br /> officer may use any appropriate records to determine the names and <br /> addresses ol owners. A copy of the notice and a list of the owners <br /> and addresses to which the notice was sent shalJ be attested to by <br /> the zoning officer and shall be made a part ok the records ut the <br /> proceedings. The failure to give mailed notice to individual <br /> property owners, or dejects in the notice, shall not invalidate <br /> the proceedings, provided a bona fide attempt to comply with this <br /> section has been made. <br /> <br /> 4. If, after any public hearing held upon an amendment~ <br />the proposed amendment is revised or further revised to include land <br />previously not affected by it, the city council shall hold another <br />public hearing, pursuant to public notice, before proceeding to vote <br />on the amendment. <br /> <br /> 5. The city council shall act upon the request within <br />forty-five (45) days after the last public hearing has been held. <br /> <br /> 6. A four-fifths (4/5) affirmative vote of the city council <br />shall be required for passage of any amendment to this chapter. <br /> <br /> <br />
