09/22/16 REVISOR CKM/IL AR4240 <br />58.1 (1) there are no alternatives for storm water treatment outside the bluff <br />58.2 impact zone on the site in question; <br />58.3 (2) the site generating runoff is designed so that the amount of runoff <br />58.4 reaching the bluff impact zone is reduced to the greatest extent practicable; <br />58.5 (3) the construction and operation of the facility does not affect slope <br />58.6 stability on the subject property or adjacent properties; and <br />58.7 (4) mitigation based on the best available engineering and geological <br />58.8 practices is required and applied to eliminate or minimize the risk of slope failure. <br />58.9 B. In the water quality impact zone, development that creates new impervious <br />58.10 surface, as allowed by exemption in part 6106.0180, or fully reconstructs existing <br />58.11 impervious surface of more than 10,000 square feet requires a postconstruction storm <br />58.12 water management permit from the local government consistent with the following: <br />58.13 (1) if a local government is covered by a municipal separate storm sewer <br />58.14 system (MS4) general or individual permit from the Minnesota Pollution Control Agency, <br />58.15 then the treatment requirements of the MS4 permit for postconstruction storm water <br />58.16 management for new development and redevelopment projects apply; <br />58.17 (2) if a local government is not covered by an MS4 permit, then runoff <br />58.18 from the new or fully reconstructed impervious surface must comply with the treatment <br />58.19 requirements in the current national pollution discharge and elimination system program <br />58.20 permit for construction storm water; <br />58.21 (3) local governments may adopt other treatment requirements approved <br />58.22 by the Minnesota Pollution Control Agency instead of those specified in subitems (1) <br />58.23 and (2); and <br />58.24 (4) multipurpose trails and sidewalks are exempt from subitems (1) and (2) <br />58.25 if there is down gradient vegetation or a filter strip that is at least five feet wide. <br />6106.0160 58 <br />
