CASE # <br /> <br /> REQUEST TO REZONE CERTAIN PROPERTY FROM <br />B-I BUSINESS TO B-2 BUSINESS; CASE OF RF DEVELOPMENT' <br />AND LYNDALE TERMINAL COMPANY <br /> By: Megan Wald, Community Development Assistant <br /> <br />Background: <br /> <br />RF Development LLC and Lyndale Terminal Company are requesting to rezone the northerly <br />portion of Outlot C, River's Bend 3~a Addition from B-1 to' B-2 Business to facilitate <br />development of the property with a convenience store with gas. <br /> <br />The following items are enclosed for your information: <br /> a) Site location map <br /> b) Proposed site plan <br /> c) Proposed findings of fact <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to owners of property within 350 feet of <br />the subject property. Staff sent hearing notices to residents within 350 feet of the subject <br />property and to residents in Rivers Bend 3~a and 4~ Addition. ~ <br /> <br />Observations: <br /> <br />The Applicants are proposing to develop a Holiday Station convince and gasoline store on the <br />northerly 1.4 acres of Outlot C, River's Bend 3f~ Addition. The remainder of the property would <br />retain the B41 Business zoning. <br /> <br />The 1.4-acre parcel is surrounded by a variety of zoning districts: commercial, multi-family <br />residential and single family residential. The B-1 Business zone allows convenience stores; the <br />B-2 zone allows convenience stores with gasoline sales. <br /> <br />Historically, the subject property has been zoned for commercial uses for 20 years. Likewise, it <br />has been a very long time, at least 10 years, since the "Permitted Uses" have been reviewed in <br />· the commercial zoning districts and may be out. of sync with the current market. The vast <br />majority of today's convenience stores include gasoline sales. The City has approved similar <br />rezonings in the urban area to accommodate other convenience store developments. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the proposed rezoning. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt Findings of Fact relating to a request from RF <br />Development LLC and Lyndale Terminal Company to rezone certain property, from B-1 <br />Business to B-2 Business. <br /> <br />Motion to recommend that City Council approve/deny the request from RF Development and <br />Lyndale Terminal Company to rezone certain property from B-1 Business to B-2 Business. <br /> <br />Reviewed By: <br />City Administrator <br />Community Development Director <br /> <br />PC: 12/05/00 <br /> <br /> <br />
