FINDINGS OF FACT <br /> JOHN JANSEN <br /> <br />1) That the applicant has properly applied for a conditional use permit to <br />operate ~nd maintain a General Rental Center. <br /> <br />2) That the applicant appeared before the Plar~ning and Zoning Commission <br />for a public hearing pursuant of City Zoning Ordinance' on July 7, 1980. <br />That the public hearing was properly advertized and that the minutes of said <br />public hearing are hereby incorporated by reference. <br /> <br />3) That the standards for consideration are as follows: <br /> <br />a) The property is zoned B-1 and this is not a permitted use~ <br />b) The adjoining properties are B-1 Business and I-1 Industrial <br />located on parcels of varying sizes. <br />c) The closest similar use is within a distance of approxi- <br />mately one (1) mile. <br />d) There will be no adverse effect to traffic flows in the <br />area. <br />e) Properly maintained, the General Rental Center should not <br />adversely affect other businesses in the area. <br /> <br />4) That the criteria for approval/disapproval are as follows: <br /> <br />a) That the establishments maintenance and operation will not <br />be detrimental to or endanger the public health, ~afety and <br />general welfare and is not contrary to established standards, <br />regulations or ordinances of other governmental agencies. <br />b) That the structure and site improvements, as indicated, as <br />a part of the applicants request, are so designed and constructed <br />that they will not be unsightly, undesirable or obnoxious in <br />appearance and that it will not hinder the orderly and harmonious <br />development of the City and the use of the district wherein <br />proposed. <br />c) That the use will not b~ substantially injurious to the <br />permitted uses nor unduly restrict the enjoyment of other <br />property in the immediate vicinity nor substantially diminish <br />and impair property values within the area. <br />d) That the establishment of the use will not impede the <br />orderly and normal development and improvement of the surround- <br />ing property for uses permitted in the zoning district. <br />e) That adequate water supply and sewage disposal facilities <br />are provided and in accordance with applicable standards, <br />f) That adequate access roads, on-site parking, on-site loading <br />and unloading berths and drainage have been or will be provided. <br />g) That adequate measures have been taken to provide ingress <br />and egress so designed as to minimize traffic congestion on <br />public roads. <br />h) That the use will conform to all applicable regulations of <br />the district wherein proposed. <br /> <br /> <br />
