PERFORMANCE CONTRACT <br />WITH <br /> THE CITY OF RAMSEY <br /> <br /> THIS AGREE~NT, made and entered into the .~.day of August, <br />1980 by and between the City of Ramsey, located in Anoka County, State of <br />~innesota, hereinafter referred to as the ~'City", and Alpaca Estates, a <br />partnership, having their principal place of business at 14146 Alpaca Street, <br />Ramsey, Minnesota, hereinafter referred to as the "Developers". <br /> <br /> WHEREAS, the Developers have applied to the City Council for <br />plat approval of two proposed plats known as Alpaca Estates and Alpaca <br />Estates Second Addition, and <br /> <br /> WHEREAS, the City Council has given approval two said prelimi- <br />nary plats, and <br /> <br /> WHEREAS, the Developers are required as a condition of plat <br />approval of said plats to enter into a contract binding them to perform <br />certain acts and duties within a specified time as a contingency to the <br />Council approving said plats, and ~ <br /> <br /> WHEREAS, the City Council requires that said contingencies be <br />performed in a timely manner, and guarantees for the performance of said <br />contingencies must be given assuring the City of full performance within <br />the certain specified period of time, and <br /> <br /> WHEREAS, the Developers have agreed to perform ~aid contingent <br />acts and duties in a timely manner, and <br /> <br /> WHEREAS, the City Council has agreed to and does grant its <br />approval to the Developers plats known as Alpaca Estates and Alpaca Estates <br />Second Addition contingent upon and conditioned upon the Developers agree- <br />ment to perform said acts and duties as are hereinafter set forth. <br /> <br />NOW THEREFORE, IT IS HEREBY CONVEMANTED AND AGREED, that the City Council <br />has granted its approval to 3Llpaca Estates and Alpaca Estates Second Addi- <br />tion plat conditioned upon and contingent upon the timely performance by <br />the Developers of the following: <br /> <br />1) That the Developers shall be responsible to meet cer- <br />tain City requirements and for the total and complete in- <br />stallation in accordance with the following schedule of the <br />improvements to the plats that are required to be installed <br />as plat improvements by and under the provisions of the City <br />Code Chapter 170.03. That said requirements and improvements <br />shall include but not be limited to: <br /> <br /> <br />
