league of <br /> <br />minnesota cities <br /> <br />July 24, 1980 <br /> <br />TO: City Clerks <br /> <br />FROM: Stan Peskar, General Counsel <br /> <br />RE: <br /> <br />POLICE FIREARMS <br /> <br />As discussed in a previous letter to city clerks, Laws 1980, Chapter 578, contains <br />a surprise provision which apparently does not allow peace officers to carry a <br />firearm on duty unless he/she has been licensed pursuant to M.So 626°84 to 626.855. <br /> <br />The hardship for communities imposed by this provision has been alleviated, at <br />least temporarily, by a court order directing the POST Board to immediately or <br />forthwith issue provisional licenses to peace officers, part-time officers and <br />constables. See the order copied on the back of this letter. The Temporary <br />Restraining Order issued by Ninth District Judge John Spellacy was based on the <br />POST Board's proposed amendments to its own rules which would eliminate the one <br />year probationary period for full-time officers and new part-time officers and <br />allow a provisional license to be issued to current part-time officers. <br /> <br />A hearing on the Temporary Restraining Order is scheduled for July 28° POST has <br />requested that it be postponed until September which would give the POST Board <br />enough time to complete the rule changes. At this time no action has been taken <br />on that request to continue. <br /> <br />Officers affected by the statutory provision may carry a firearm in the interim. <br />Pursuant to the court order, their records at the POST Board have been amended to <br />indicate that they are licensed, pursuant to POSt Board requirements° <br /> <br />(OVER) <br /> <br /> SP:rmm <br /> 7/24/80 <br />''ii(Z) h~.s~',o',/or bLJ~lding, 480 cedar street, saint paul, minnesota 55101 <br /> <br /> <br />
