league of <br /> <br />minnesota cities <br /> <br />July 24, 1980 <br /> <br />TO: City Clerks <br /> <br />FROM: Stan Peskar, General Counsel <br /> <br />RE: <br /> <br />POLICE FIREARMS <br /> <br />As discussed in a previous letter to city clerks, Laws 1980, Chapter 578, contains <br />a surprise provision which apparently does not allow peace officers to carry a <br />firearm on duty unless he/she has been licensed pursuant to M.So 626°84 to 626.855. <br /> <br />The hardship for communities imposed by this provision has been alleviated, at <br />least temporarily, by a court order directing the POST Board to immediately or <br />forthwith issue provisional licenses to peace officers, part-time officers and <br />constables. See the order copied on the back of this letter. The Temporary <br />Restraining Order issued by Ninth District Judge John Spellacy was based on the <br />POST Board's proposed amendments to its own rules which would eliminate the one <br />year probationary period for full-time officers and new part-time officers and <br />allow a provisional license to be issued to current part-time officers. <br /> <br />A hearing on the Temporary Restraining Order is scheduled for July 28° POST has <br />requested that it be postponed until September which would give the POST Board <br />enough time to complete the rule changes.
