Motion by Chairperson Nixt, seconded by Commissioner Jeffrey, to close the public hearing.

Motion carried. Voting Yes: Chairperson Nixt, Commissioners Jeffrey, Brauer, Van Scoy and
Watson. Voting No: None. Absent: Commissioners Johnson and Shepherd.

The public hearing was closed at 8:32 p.m.

Commission Business

Chairpcrson Nixt called the regular meeting of the Planning Cmranission back to order at 8:32
p.m.

Connnissioner Van Scoy inquired about the structures on the property in relation to being
temporary agricultural buildings.

Assistant Community Development Director Trudgeon reviewed the location and structure of the
buildings, lqe noted there are concrete paths between some of the greenhouses.

Commissioner Van Scoy inquired about the concrete on the site.

Mr. Rowe explained there is a concrete slab in some of the greenhouses to stop weeds from
growing and to eliminate muck, water build up, and bugs. The concrete is just a floating slab,
and is only about two inches thick.

Comm i ssi oner Van S coy questioned if the structures are considered agricultural.

Mi-. Rowe replied the buildings are for an agricultural use.

Commissioner Van Scoy asked how long the property has been treated as temporary agricultural.

Assistai~t Community Development Director Trudgeon replied it has been treated as temporary
agricultural since 1977.

Commissioner Brauer commented if they look at the big picture the expansion has been
incremental over time. At some time they have to look at this entire thing.

Chair Nixt stated before any further expansion can be allowed it needs to be determined if there
are any material code violations. With any further expansion beyond the 30,000 square feet this
must be brought into compliance with code.

Assistant Connnunity Development Director Trudgeon indicated the appropriate discussions for
this property need to happen without the pressure of timing.

Chairperson Nixt informed the applicant he knows he runs a good operation but the conditional
use permit runs with the land and they do not know who will have the land next.

Mr. Rowe replied inquired about the 35 percent cap.

Planning Commission/August 5, 2004
