was assigned by the appraiser. However, the tree impacts were not a serious issue with Mrs. <br />Geving. A more significant issue is a potential conflict with the septic system. The system is <br />supposed to be in the front of the house and may be in the area crossed by the proposed trail. The <br />appraisal mentions this fact and states that the appraised value does not include any damages for <br />impact to thc septic system, but that the City would be responsible for such damages if they were <br />found to be necessary. The house was constructed in 1950 and a subsequent review of the <br />property filc reveals no information for this system. If the system would be impacted by the trail <br />construction, and the City were to replace the system as suggested by the appraisal report, the <br />cost o£ the replacement could easily exceed the $6,200 damage award. In addition, this lot is <br />only 0.5 acres and the City is proposing to acquire 25 percent of this area. It raises the question <br />as to whether sufficient area exists to install a replacement system. Staff suggests that the City <br />hire a certified soil tester to examine the system, determine the existing system's location and <br />whether sufficient area exists for a replacement system elsewhere on the remaining lot area. <br />Beyond this septic system issue, Mrs. Geving did indicate that she felt that the minimum of <br />$8,000 would be acceptable payment for the easement. <br /> <br />Assistant Public Works Director Olson advised Mr. and Mrs. Prokopio felt the appraisal price of <br />$5,400 was Iow, particularly with regard to the damage of tree loss, which is $725. When staff <br />left the meeting with the Prokopios they had indicated that they would probably be obtaining <br />their own appraisal. Mrs. Prokopio subsequently called staff on August 13th to inform them that <br />they decided against getting a second appraisal but indicated that a settlement of $8,500 would be <br />acceptable to them. <br /> <br />Councilmember Elvig stressed the need to move quickly on this trail, as many children are forced <br />off of thc trail onto the road with their bikes. <br /> <br />Mayor Gamec commented in regards to the counter offers, there may be some room for <br />negotiation, and if an agreement is not met with the property owners the extra money would <br />likely end up going to attorneys. <br /> <br />Public Works Director Kapler suggested a cap be placed on the authorized negotiated amount in <br />relation to the drain field. <br /> <br />The consensus of the Council was to authorize staff to proceed with the counter proposal of Mr. <br />and Mrs. Prokopio at the requested amount, and to proceed with the counter proposal of Mrs. <br />Geving with consideration of the septic system taken into account. <br /> <br />3) TH 47 Modifications <br /> <br />Assistant Public Works Director Olson reviewed that in June the Public Works Committee <br />recommended that MnDOT be asked to perform a signalization study and investigate some <br />options for improving the safety of the TH 47/142~d Street intersection by possibly restricting left <br />turning movements. MnDOT has stated the signal warrants are not met at the intersection. <br />MnDOT is proposing an extension of the median through the intersection of 142~d Avenue.
