Absent: Commissioners Reeve, Sweet, and Watson. <br /> <br />Case #9: <br /> <br />Request to Rezone the Proposed Plat of Wildlife Sanctuary 2"a Addition from <br />R-1R Single Family Rural to R-1U Single Family Urban Residential; Case of <br />Oakwood Land Development <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 9:15 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 9:15 p.m. <br /> <br />Presentation <br /> <br />Associate Planner Wald stated Oakwood Land Development has submitted an application to <br />rezone Lots 1 and 2, Block 1, Wildlife Sanctuary Addition from R-1 Rural Residential to R-1 <br />Urban Residential. The rezoning would allow the applicant to redevelop the property into single <br />family urban lots. The 2001 Comprehensive Plan identifies this area for low-density residential <br />development and low density development has been established at 3 units per acre. The City has <br />received a preliminary plat proposing to subdivide the subject property into 42 single-family lots. <br />The City has also received a rezoning application from Kelsey Gustafson, who owns Lot 3, <br />Block 1, Wildlife Sanctuary Addition (south of the subject property), to rezone his homestead <br />from R-1 Rural Residential to R-1 Urban Residential. <br /> <br />Citizen Input <br /> <br />Gene Gile, 15710 St. Francis Boulevard, noted his property adjoins the Gustafson property. He <br />explained that when Wanda Gustafson, original owner of the property under discussion, split her <br />property off to her children, she stated she did not want the property developed. He said the first <br />5 acres were split off to her son. The second 5 acres were split offto Kelsey Gustafson under the <br />condition that it be left in the Wildlife Sanctuary. She had agreed to leave it in the Sanctuary <br />because she did not want it developed. He suggested this be researched. He questioned whether <br />it can be rezoned and developed. <br /> <br />Community Development Director Frolik stated she worked on the platting of the Wildlife <br />Sanctuary the first time it was platted.
