3) 4) 5) That the noise control issue and the buffering and screening plan be worked out with Staff before presenting to the Council Number 4 should be modified as follows: That the Permittee herein agrees to submit a screening plan to the City for review and approval for the purpose of screening the intense industrial activities from public view on 140t~ Avenue N.W. The screening wall shall be at least 10 feet tall. The construction materials for the screening wall are subject to the approval of the City and consideration will be given to the level of maintenance required, durability, effectiveness and appearance. The terms of implementation be agreed upon for the conditional use permit. Number 5 should be modified as follows: That the applicant will pave all areas in accordance with City Ordinances. Add 13) That provision is made to bring the pollution control system into compliance with completion date to be discussed with Staff and they be maintained in a functioning fashion. Case #2: Request for a Conditional Use Permit to Grade and Export Soils; Case of Eric Thomsen Chairperson Nixt closed the regular portion of the Planning Commission meeting at 9:38 p.m. in order to call the public hearing to order. Public Hearim, Chairperson Nixt called the public hearing to order at 9:38 p.m. Presentation City Engineer Steve Jankowski stated the City has received an application from Eric Thomsen to grade and export soils from an area generally located west of T.H. #47 and south of County Road #63, at about Vanadium Street N.W. The subject property consists of 63 acres; the proposed activity would be confined to 9 acres. The City Council originally approved a conditional use permit for grading and exporting of soil from this property on March 25, 1997. The applicant did not initiate the conditional use permit within this three-year timeframe. The applicant subsequently applied for and received a new conditional use permit to mine material on May 23, 2000, which was to expire two years from the date of commencement of the operation, but no later than three years from the date of issuance. Material was mined for the T.H. 47 project in June 2000, and for additional uses thereafter. The applicant desires to continue the mining and grading operation to completion of the original proposal of nine acres; and has reapplied for a continuation of the mining and grading conditional use permit.
