The applicant has submitted a revised copy of the original site plans showing <br />the existing spot elevations in the excavated area. This submittal coupled with a site visit leads <br />staff to conclude the site is in compliance with the conditions of the current permit, however, <br />restoration has yet to be initiated. Silt fence is currently in place around the site. Drainage is <br />directed toward a sump area, having a bottom elevation of approximately 869, which is located <br />along the eastern border of Phase I. Topsoil has been stockpiled along the eastem perimeter of <br />the site. The location of the topsoil stockpiles should be better identified on the map submittals. <br />A map should be provided showing the proposed final grades. He also noted that a permit needs <br />to be obtained from the Minnesota Pollution Control Agency (NPDES permit). In addition, a <br />permit may be required from the Lower Rum River Water management Organization. She <br />wanted to be assured he will comply with sweeping and watering down the dust. The operation is <br />going from 7:30 a.m. to 5:00 or 6:00 in the evening, and creates a lot of dust. <br /> <br />City Engineer Jankowski stated the draft conditional use permit contains a condition addressing <br />this issue. It addresses the wind speed and when the operation should cease. <br /> <br />Chairperson Nixt questioned the condition listing the operation shall be conducted between 7:00 <br />a.m. and 8:00 p.m. on weekdays. <br /> <br />City Engineer Jankowski responded these hours may have been negotiated at the last conditional <br />use permit.
