setbacks. However. the existing detached garage is located in the front yard, nearer the front
proper~y tine than the home. Therefore, the applicant also applied for a variance for the location
of the addition. The Board of Adjustment approved the variance request at their September 2,
2004 meeting.

Assistant Community Development Director Trudgeon indicated the City has received a
complaint regarding off-street parking and condition of premises matters on the subject property
and is currently working with the applicant to bring the property into compliance with these
ordinances. The Planning Commission noted this and determined that this request and the code
enfbrcement case are two separate matters and that the overage requested is not unusually large.
Therefore, the Planning Commission recommended 'that the Council approve the request for a
Conditional Use Permit and staff will continue to work on resolving the ordinance violations.

Mayor Gamec noted for the record, the City received three letters from citizens of the
sm-rounding area.

Michael Mettler, applicant, stated he is trying to get organized and get on with his life, and keep
working.

Councilmember Kurak asked how the applicant addresses the concern of neighbors that the
addition i-nay not be completed in a timely fashion.

Mr. Mettler replied the problem was that the siding on the existing garage is extremely faded.
He informed City staff that he wanted to change the color of the garage from a light ~'ay to a
slate ~ay, and asked what he could do because he does not have enough money to do the
existing garage and the addition fight nbw. He was told he would have one year after the
completion of the addition to have both sides matching. That is not a problem; he does not have
the money this fall, but next spring he will. He wants 'to redo the whole house, which will all go
back to natural wood.

Councihnelnber Kurak explained there is concern.from neighbors that the addition might not be
completed. She required what the addition would look tike.

Mr. Mettler replied the dimension of the existing garage is 22 feet by 30 feet, and isnot deep
enough to accommodate full vehicles. He wants to add on to the east side of the existing
building with dimensions of 40 feet by 24 feet, so he can have storage on both sides and still park
his work vans, inside. His neighbor wanted him to bhng the existing garage and the addition on
the same roofline, and he informed him if that was feasible without a ~'eat cost to him, that
would be fine. But it is quite a bit of cost, because the whole roof would have to be removed.

Councihnember Cook requested clarification that the addition will be sided, but it may take one
year for the siding to match, not that the applicant will not be siding the garage this year.

Mr. Mettler replied that is correct. He did not have enough money to purchase the new siding
and also replace the old siding. He told the inspector this and he said the City has worked with

P42

Cit2,,' Council/September 13, 2004
