Commission Business

Chairperson Nixt called the regular meeting of the Planning Commission back to order at 8:59
p.m.

Assistant Community Development Director Trudgeon advised he would suggest that the
Commission recommend approval of this preliminary plat contingent on either the applicant
being able to get an access to line up with 147th Avenue, or platting the right-of-way to 148r~
Avenue. Staff will then be able to continue dialogue with the county.

Chairperson Nixt questioned how that would solve the problem with the parcel on the comer.

Assistant Community Development Director Trudgeon replied it does not.

Commissioner Brauer siated he coutd-notapprove access off of 148~h Avenue that would run
through the neighborhood.

Chairperson Nixt indicated there should not be access tlzrough the residential neighborhood. He
commented it would be preferred that the access tine up ~vith 147th Avenue, however, since that
will not be allowed, the only logical access would be as a right-in/right-out at 148® Avenue
where it ts proposed to line it up. He indicated he does not think they need the fight-of-way if
148m Avenue ends in a cul-de-sac and there is no ingress or egress to this site from the
neighborhood.

Commissioner Brauer suggested the Commission state that they do not want the access through
the residential neighborhood and that the Commission approve the plat With the 'applicant to.
work out an access with the county. It should be stated that the Commission is in agreement
with the applicant regarding the access at 147th Avenue.

Mr. Schmidt reviewed a letter from the county dated February [6, 1996 recommending that the
access at 147® Avehue remain. He stated there is already access at 147th Avenue on the west,
and he does not think the county has wiggle room to take the access away from this piece,
coupled with the 1 ¥: acre piece. He thinks this letter dictates to the county that they will have to
approve this. It will probably take pressure from county commissioners, but he thinks he can get
that. He is comt'ortab[e with the Commission approving this with him working with the county.
He does not want to run traffic through the residential neighborhood. He suggested that the
Commission recommend an outlot be created to create access to the parcel to the south. He
explained he can use that for leverage with the county. He noted the other issue is that, staff has
discussed making a cul-de-sac where 148~1 Avenue comes into his property. This would impact
setbacks I:br him substantially and he would lose up to 18 storage units. This is a substantial
requirement beifig imposed on the property. He is willing to drop his privacy fences back about
30 t'eet to allow the plow to drop the snow on the boulevard, which is what is currently done.

Chairperson Ni. xt suggested the possibility of a setback variance. This would provide the
permanent surface and the applicant would have a variance fbr a few units so as not to lose
revetme, l/lc indicated staff can work this issue octt to require the minimum Cul-de-sac necessary.

Planning Commission/August 5, 2004

11
