Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-11- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF' 'FACT # RELATING TO A <br />REQUEST FOR A VARIANCE TO THE TWENTY (20) FOOT PAVEMENT SETBACK <br />FROM PUBLIC STREET RIGHT-OF-WAY. <br /> <br /> WHEREAS, TSM Development, Inc., hereinafter referred to as ~"Applicant," has <br />properly applied for a variance from Section 9.20.24 regarding minimum pavement setbacks <br />from public street right-of-way in the E-1 Employment District on the property generally located <br />on Ramsey Bird and Bunker Lake Blvd and legally described as follows: <br /> <br />0utlot A, Regency Pond, Anoka County, Minnesota. <br /> <br />(the ;:Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, aa follow, s: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey Ci.ty Code on November 4, 2004, and that said public hearing was properly <br />advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />2. That the Subject Property is zoned E-1 Employment and is approximately 4.8 acres in size. <br /> <br />3. That properties to the north and east are zoned R-1 Residential. <br /> <br />4. That the property to the south and west is street right of way. <br /> <br />5. That mini storage is a permitted use in the E-1 Employment District. <br /> <br />6. That section 9 ? '~ <br /> ._0.;.4 (E-1 Employment District) requires a twenty (20) ~bot setback between <br /> any pavement and public street right-of-way. <br /> <br />That the Applicant is requesting a variance from the 20-foot pavement setback requiremen'~ <br />along the cul.cle sac of 148th Ave NW in order to install the required curbing and a <br />bituminous surI:ace up to zero (0) feet of the property line. <br /> <br />That thc :\pplicant has stated, that given the unusual shape of the subject property, it is' <br />practically di/Sficult to develop the site to its potential and accommodate a 20-foot setback to <br />the cul cie sac on [48® Ave NW. <br /> <br />13 <br /> <br /> <br />
