Mr. Shappell stated it is under the control of the Northfork Board of Directors, but not for
architectural control.

Commissioner Johnson stated he understands the benefit of getting things under cover inside a
building and another issue is whether this building is reasonably screened.

Mr. Shappell stated no trees will be cut down and there is a 50 to 60 foot heavy tree buffer to the
closest house. He again stated that he has signatures from the closest neighbors who have signed
a letter saying they have no objection.

Commissioner Kociscak asked where the opposing neighbor resides.

Mr. Shappell stated that neighbor resides on the lot next to the garage. He noted that whether the
permit is granted or not, a garage will be built and that neighbor will be next to the garage.

Community Development Director Frolik displayed a picture of the site and vegetation present
for screening.

Mr. Shappell stated the trees that will be removed will be on the other side and noted the
driveway is ten feet from the property line. He stated the objecting neighbor has only two
windows on that side of the garage: living room and dining room windows. He stated with the
color of the garage, it will blend with the vegetation.

Motion by Commissioner Nixt, seconded by Commissioner Johnson, to close the public hearing.

Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Kociscak, and Reeve.
Voting No: None. Absent: Commissioners Brauer and Watson.

The public hearing closed at 7:28 p.m.

Commission Business

Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:28
p.m.

Motion by Commissioner Johnson to recommend that City Council adopt findings of fact
relating to David and Sandra Shappell's request for a conditional use permit to exceed the
accessory building size restriction.

The motion failed for lack of a second.

Motion by Commissioner Johnson, seconded by Commissioner Nixt, to table consideration of
the David and Sandra Shappell request for a conditional use permit to exceed the accessory
building size restriction to the October 10, 2002 Planning Commission meeting.

Planning Commission/October 3, 2002
